Please read these Terms carefully before using TradeHaven. By accessing or using our platform, you agree to be bound by these Terms.
1. About TradeHaven
TradeHaven is an online directory and lead generation platform operated by TradeHaven Pty Ltd (ABN 78 956 079 096) ("TradeHaven", "we", "us", "our"). The platform connects customers seeking trade and home services ("Customers") with registered service providers ("Businesses") across Australia.
TradeHaven is a directory and introduction service only. We do not perform, supervise, or guarantee any trade or home services listed on the platform. We are not a party to any agreement formed between Customers and Businesses.
2. Acceptance of Terms
By accessing our website or using our services, you confirm that you:
- Are at least 18 years of age;
- Have the legal capacity to enter into a binding agreement; and
- Agree to comply with these Terms and all applicable Australian laws.
If you are using TradeHaven on behalf of a business, you confirm you have authority to bind that business to these Terms.
3. Our Services
3.1 For Customers
Customers may use TradeHaven to search for Businesses, view Business profiles and reviews, and submit quote requests. TradeHaven provides these features free of charge to Customers.
3.2 For Businesses
Businesses may create a profile on TradeHaven and be listed in our directory. Business accounts are subject to the subscription plan chosen (Free, Pro, or Premium) or pay-per-lead credits. Plan features, pricing, and billing terms are set out on our Pricing page.
4. Business Listings & Verification
Businesses are responsible for ensuring all information in their profile is accurate, current, and not misleading. This includes licence numbers, insurance details, service areas, and pricing.
TradeHaven may conduct basic verification checks on licence information, but does not guarantee the accuracy of any information provided by a Business. Customers should conduct their own due diligence before engaging any Business.
We reserve the right to remove or suspend any listing that we reasonably believe contains false, misleading, or inappropriate information.
5. Leads & Payments
5.1 Lead Delivery
When a Customer submits a quote request, that request may be delivered to one or more Businesses based on their trade type and location. TradeHaven does not guarantee any minimum number of leads and lead volume may vary.
5.2 Subscriptions
Subscription fees are billed monthly in advance. Subscriptions automatically renew unless cancelled at least 24 hours before the next billing date. Prices are in Australian Dollars (AUD) and include GST.
5.3 Pay-Per-Lead Credits
Lead credits are purchased in advance and deducted when a Business unlocks a lead. Credits do not expire. Credits are non-refundable once a lead has been unlocked.
5.4 Refunds
We offer a pro-rata refund for unused subscription days if you cancel within 7 days of your first subscription payment. After 7 days, no refunds are provided for subscription fees. Lead credits are non-refundable.
6. Prohibited Conduct
You must not use TradeHaven to:
- Provide false, misleading, or deceptive information;
- Post fake reviews or manipulate ratings;
- Solicit Customers or Businesses outside of the platform to circumvent our lead system;
- Harvest or scrape data from our platform;
- Engage in any conduct that is unlawful, harassing, or harmful to others;
- Infringe the intellectual property rights of TradeHaven or any third party.
7. Reviews & Content
Customers may leave reviews of Businesses they have engaged through TradeHaven. Reviews must be honest, fair, and based on a genuine experience. We reserve the right to remove reviews that violate our content standards.
By submitting content (including reviews, photos, or business descriptions), you grant TradeHaven a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content in connection with our services.
8. Limitation of Liability
To the maximum extent permitted by Australian law, TradeHaven's total liability to you for any claim arising from your use of our platform is limited to the fees paid by you to TradeHaven in the 3 months preceding the claim.
TradeHaven is not liable for any indirect, incidental, special, or consequential loss, including loss of profits, data, or business opportunity, even if we have been advised of the possibility of such loss.
Nothing in these Terms excludes, restricts, or modifies any rights or remedies you have under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.
9. Intellectual Property
All content on the TradeHaven platform, including our logo, design, text, and software, is owned by or licensed to TradeHaven Pty Ltd and is protected by Australian copyright law. You may not reproduce or use our content without prior written permission.
10. Privacy
Your use of TradeHaven is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
11. Termination
We may suspend or terminate your account at any time if we believe you have violated these Terms, or for any other legitimate business reason with reasonable notice. You may close your account at any time by contacting us at hello@tradehaven.com.au.
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
13. Changes to These Terms
We may update these Terms from time to time. We will notify registered Business users by email before material changes take effect. Continued use of TradeHaven after changes constitutes acceptance of the updated Terms.
